Terms of Service

1. Who These Terms Apply To

The Service is offered to schools, colleges, universities, coaching centres, consultancies and other institutions ("Institution") that subscribe to the platform, and to the individuals an Institution grants access to — students, parents/guardians, teachers, administrative staff and other authorised users ("User", "you").

2. Description of Service

TACHY SCHOOL ERP is a multi-tenant software-as-a-service platform for managing admissions, attendance, academics, examinations, fee collection, staff/HR, communication and related administrative functions for an Institution. Available features vary by the plan/modules an Institution has enabled (for example, AI-assisted attendance, geofenced staff attendance, or payment gateway integration are optional and Institution-controlled).

3. Accounts

• Institution accounts and the initial administrator account are set up when an Institution subscribes to the Service.
• Individual User accounts (students, parents, staff) are created and managed by the Institution's administrators.
• You are responsible for keeping your login credentials confidential and for all activity under your account. Notify your Institution's administrator or us immediately at care@tachy.in if you suspect unauthorised access.
• You must provide accurate information and keep it up to date where the Service allows you to do so.

4. Institution Responsibilities

An Institution using the Service is responsible for:

• Obtaining any consent required from students, parents/guardians and staff before entering their data on the platform (e.g. for AI attendance or location-based features)
• The accuracy of academic, attendance, fee and other records it maintains on the platform
• Managing which staff have administrative access, and revoking access when a staff member leaves
• Its own compliance with applicable education, labour and data protection law as a data controller for its students'/staff's records

5. Fees & Payments

• Subscription fees: Institutions subscribing to the Service pay TACHY according to the plan agreed at onboarding. Invoices and payment terms are as communicated separately to the Institution.
• Fee collection: Where an Institution enables online fee collection, TACHY facilitates payment via a third-party payment gateway; the Institution remains the recipient of student/parent fee payments, and TACHY acts as a technology facilitator, not the merchant of record for those fee payments.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose, or to harass, defame or harm another person
• Attempt to gain unauthorised access to another User's account or to any part of the Service you're not authorised to access
• Upload malicious code, or interfere with or disrupt the integrity or performance of the Service
• Scrape, reverse-engineer, or resell access to the Service without our written permission
• Upload content you don't have the right to share, or that infringes another person's rights

7. Third-Party Services

The Service integrates with third-party providers — payment gateways (Cashfree, Razorpay, Stripe, Paytm, SabPaisa), messaging providers (WhatsApp Business Platform via Chat Tachy, SMS, email) and cloud infrastructure providers. Your use of those integrations is also subject to that provider's own terms.

8. Intellectual Property

The Service, including its software, design and TACHY branding, is owned by TACHY EDTECH PRIVATE LIMITED and protected by applicable intellectual property law. Institutions and Users are granted a limited, non-exclusive, non-transferable right to use the Service for its intended purpose during an active subscription. Data you or your Institution enter into the Service remains yours/the Institution's — we don't claim ownership of your academic or business records.

9. Privacy

Our collection and use of personal data through the Service is described in our Privacy Policy, which forms part of these Terms.

10. Service Availability & Disclaimers

We aim to keep the Service available and reliable, but it is provided "as is" and "as available" without warranties of any kind, express or implied, including uninterrupted or error-free operation. We may perform scheduled maintenance, and features may change as the platform evolves.

11. Limitation of Liability

To the maximum extent permitted by applicable law, TACHY shall not be liable for any indirect, incidental, special or consequential damages arising from use of, or inability to use, the Service. Our total liability for any claim relating to the Service is limited to the subscription fees paid by the relevant Institution for the affected period.

12. Indemnification

You agree to indemnify and hold TACHY harmless from any claim arising from your breach of these Terms, misuse of the Service, or violation of any law or third-party right.

13. Suspension & Termination

We may suspend or terminate access to the Service for an Institution or User that breaches these Terms, engages in fraudulent or abusive conduct, or where required by law. An Institution may cancel its subscription per the process described in our Refund & Cancellation Policy.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts at Patna, Bihar, India.

15. Changes to These Terms

We may update these Terms from time to time; the "Last updated" date above will change accordingly. Continued use of the Service after an update constitutes acceptance of the revised Terms.
